These conditions are issued by Worn Out Limited (Scottish Company No SC276952), Registered Office: 216 West George Street, Glasgow, Scotland G2 2PQ ("Worn Out")

When you register for the Teetonic.com tee-shirt rating competition (the "Competition") you agree to be bound by the terms and conditions set out below. If you do not agree to these terms and conditions your registration will be invalid and you may not participate in the Competition.

Voters in the Competition must be 16 years of age or above.
You can rate the design using the rating rubbish, could do better, okay, nice one, I love it. Your rating and any comments you submit on the design will be factors (but not the only factors) considered by the judges when determining the winner of the Competition. Any comments you submit may be passed to the designers, and may be used by Worn Out in promoting or advertising future Competitions or the business operated through Teetonic.com.
The winning design will be selected on a regular basis by the judges selected by Worn Out in its sole discretion - depending on the timescale appropriate for the Competition. The criteria for a winning design will be assessed on a combination of factors including (but not limited to) the number of votes cast for each design, the rating of votes cast for each design and the comments made by voters for each design.
The judges' decision on all matters relating to the winning design is final.
By voting in the competition you warrant that no comments submitted by you to the Site will violate any right of any third party, including but not limited to their copyright, trademark, design right, privacy or other personal or proprietary right(s) whether registered or unregistered.
You also warrant that no comments submitted by you to the voting site will be or contain defamatory or otherwise unlawful, abusive, offensive or obscene material.
All comments are accepted in good faith and Worn Out will not be deemed liable for any damages incurred to any third party by the publication of your comments.
You are and shall remain solely responsible for the content of any comments you submit.
You agree to indemnify Worn Out and keep Worn Out indemnified fully against any and all loss, injury, damage, costs or expenses incurred by Teetonic as a direct or indirect consequence of your breach of these terms and conditions.
If Worn Out in their sole discretion find that these terms and conditions have been breached, Teetonic may at any time withdraw from the site the comments submitted by you and delete your registration details from the site. Worn Out shall be entitled to retain your details and refuse or cancel any subsequent registration requested or made by you.
The designs submitted to the competition will be posted on the website for voting for a period set by Worn Out in its sole discretion (normally of thirty days but in some cases a shorter or longer period) during which time you will be able to register one vote per design.
Multiple votes per design will not be permitted from any one e-mail address or customer number. You agree that you shall not whether alone or in concert with any other(s) attempt to manipulate the result of the Competition (whether by submitting multiple votes in the same Competition or by making multiple registrations or in any other way.) In the event that Worn Out suspect that you have breached this condition, they shall be entitled to disregard votes cast by you and delete your registration details from the site. Worn Out shall be entitled to retain your details and refuse or cancel any subsequent registration requested made by you.
The winner of the competition will have his design printed on the Worn Out tee-shirt which will normally be available for sale the following month. If you have voted or are a registered member with teetonic.com you will be notified by email of the winning design and when the tee-shirt will be available for sale, and you agree that Worn Out may retain your details and contact you for this purpose.
You will be asked if you wish to provide biographical information about yourself and your contact details for publication on the website. This may include your name, email address, home address, biography and commentary on the designs. If you do provide biographical information and contact details you warrant that they are accurate and complete and give your express permission that they may be posted by Teetonic on the website for a period of time determined by Teetonic. Teetonic shall be entitled to edit your biographical information and contact details.
Your contact details will be used by Worn Out to run the Competition, for the administration of sales of tee-shirts to you, and to provide you with details of goods and services provided by Worn Out. Your biographical information may be used by Worn Out for its own internal business planning purposes, and in promoting or advertising future Competitions or the business operated through Teetonic.com. Worn Out will not sell your biographical information or contact details to any third party.
Worn Out will not be held responsible for any problems arising from the provision or publication of these details or from contacting anyone via details provided on the web site.
Except for any liability which cannot be excluded or limited under applicable law, Worn Out, the judges and any other party involved in operating the Competition, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in delict (including without limitation negligence), contract or otherwise) in connection with the Competition in any way.
The Competition and these terms and conditions shall be governed by and construed in accordance with Scots law. Disputes arising in connection with the Competition and/or these terms and conditions shall be subject to the exclusive jurisdiction of the Scottish courts.

Teetonic.com competition entries Legal Terms and Conditions

When you enter a design (the “Design”) into the Teetonic.com tee-shirt competition (the “Competition”) you agree to be bound by the terms and conditions set out below. If you do not agree to these terms and conditions your entry will be invalid and you may not participate in the Competition.

Entrants to the Competition must be 16 years of age or above. Worn Out reserves the right to withdraw or cancel any entry by an entrant who cannot provide to Worn Out suitable evidence of age in a form acceptable to Worn Out.
You may submit a Design for the Competition only by using the design template provided by Worn Out (downloadable from the Teetonic.com website) and by complying with the design rules and conventions set out on the website. Any failure to do so shall entitle Worn Out to reject your entry which will not then be eligible to participate in the Competition, although conditions 12 to 18 (inclusive) shall still apply to the Design submitted.
Unless Worn Out determines otherwise, the Designs submitted to the Competition will be posted on the Teetonic.com website for voting for a period set by Worn Out in its sole discretion (normally of thirty days but in some cases a shorter or longer period. ) Worn Out is not obliged to accept any entry for the Competition, and may in its sole discretion reject any entry or withdraw it from the Competition at any time. Worn Out shall be entitled to edit any comments submitted by you along with the Design.
The winning design will be selected on a regular basis by the judges selected by Worn Out in its sole discretion – depending on the timescale appropriate for the Competition. The criteria for a winning design will be assessed on a combination of factors including (but not limited to) the number of votes cast for each design, the rating of votes cast for each design and the comments made by voters for each design.
The judges’ decision on all matters relating to the winning design is final.
The winner of the competition will have his design printed on the Worn Out tee-shirt which will normally be available for sale the following month (or in such later month as Worn Out deem appropriate).
The winning designer will be notified by e-mail. The prize(s) payable to the winning designer will be clearly stated on the Teetonic.com site in the section relating to the relevant Competition. Prizes may vary in Worn Out’s discretion and Worn Out reserves the right to substitute prizes of equivalent nature and/or value for the prizes mentioned on the Teetonic.com site. If the section of the Teetonic.com site relating to the relevant Competition does not specify a particular prize, the following provisions shall apply:
1. The winning designer will receive a prize of £100 Sterling payable by cheque (or if preferred) vouchers worth £100 redeemable at Teetonic.com.
2. A further £0.50 Sterling per tee-shirt sold with the winning Design printed on it will also be paid by cheque to the designer once a sales threshold of 50 tee-shirts has been sold.
Payments shall be made at intervals no more regularly than quarterly. An equivalent value in Teetonic.com vouchers is available as an alternative to payment in Sterling. Worn Out shall pay any sum due by cheque by posting a cheque payable to the name entered by the winning designer to the postal address submitted by him/her. Time of payment shall not be of the essence and to avoid incurring unnecessary administrative costs Worn Out may delay payment until such time as a sum of £25 or more is due to the winning designer.

Worn Out may set-off any sum due to it by the winning designer against any sum due to be paid by it to the winning designer.
If your Design wins the competition, you agree that your submission of that Design constitutes an assignation to Worn Out of all Rights in that Design (the “winning Design”). Worn Out will own exclusively all Rights and shall not be limited in any way in its use, for commercial or other purposes, of any winning Designs. All winning Designs shall become and remain Worn Out property. However, if in time you wish to use the winning Design for commercial purposes yourself, Worn Out will always act positively towards any proposal by you to use the winning Design for commercial purposes and act reasonably in negotiating an agreement on suitable terms for such use by you.
For the purposes of these terms and conditions, “Rights” shall mean all rights, title and interest in and to any copyright, inventions, discoveries, trade names, trade marks (registered and unregistered) designs and design rights (registered and unregistered), badges of trade, get-up, and any other intellectual property rights of a cognate or similar nature arising anywhere in the world in the Design.
To the extent that any Rights in winning Designs do not automatically vest in Worn Out by operation of law, you shall hold such Rights on trust for Worn Out and shall assign such Rights to Worn Out on demand. You shall at the request of Worn Out do all acts and execute all such further documents, forms and authorisations as may be required to vest the Rights in winning Designs in Worn Out. You irrevocably appoint to be your attorney or agent in your name and on your behalf to do all such acts and things and to sign all such documents and forms as may be necessary in order to vest the Rights in winning Designs in Worn Out. You also agree that, with respect to any third party, a certificate signed by any duly authorised officer of Worn Out that any act or thing or document or form falls within the authority hereby conferred shall be conclusive evidence that this is the case.
You waive your whole moral rights in any winning Design of yours. You may however display or archive any winning Design in a portfolio or personal collection. Unless you have agreed otherwise (as mentioned in condition 9), you may not sell or reproduce the winning Design for commercial purposes (which would include but are not limited to selling or commercially licensing the winning Design or derivatives of the winning Design).
By submitting a Design for the Competition, you agree that (whether or not that Design wins the Competition), Worn Out may use that Design in promoting or advertising future Competitions or the business operated through Teetonic.com, including but not limited to featuring it on Teetonic.com and in any promotional emails, bulletins, leaflets, flyers, posters and/or other advertising or marketing materials. However, unless otherwise agreed with you Worn Out shall not be entitled to sell any tee-shirts which feature that Design or make any other use of the Design except as set out in this condition.
By entering the Competition you warrant that no Design or comments submitted by you to Teetonic.com will violate any right of any third party, including but not limited to their copyright, trademark, design right, privacy or other personal or proprietary right(s) whether registered or unregistered and that the Design has not previously been submitted to any other competition. Any comments you submit may be used by Worn Out in promoting or advertising future Competitions or the business operated through Teetonic.com
You warrant that:- (a) you are the owner of the Rights; (b) you have not created the Design as an employee in the course of your employment; (c) the Design is entirely your own original work; (d) you have full power and authority to enter into the Competition on these terms and conditions and have not assigned or granted a licence of the Rights to any third party; and (e) you shall do nothing to prejudice or threaten the validity of the Rights.
You warrant that no comments or Designs submitted by you to the Competition will be or contain defamatory or otherwise unlawful, abusive, offensive or obscene material
All Designs and comments are accepted in good faith and Worn Out will not be deemed liable for any damages incurred to any third party by the publication or production of your design.
You are and shall remain solely responsible for the content of any Designs or comments you submit.
You agree to indemnify Worn Out and keep Worn Out indemnified fully against any and all loss, injury, damage, costs or expenses incurred by Worn Out as a direct or indirect consequence of your breach of these terms and conditions.
If Worn Out in their sole discretion find that these terms and conditions have been breached Worn Out may at any time withdraw from the site the Design and/or comments submitted by you. In the event that a Design has been a winning design and prize money has been paid you shall immediately repay all such money to Worn Out, which shall be entitled to take all appropriate steps to recover such money and you agree that you will be liable for any cost incurred in the production of the tee shirts and subsequent loss of sales. Worn Out shall be entitled to retain your details and refuse or cancel any subsequent Competition entry made by you.
You will be asked if you wish to provide biographical information about yourself and your contact details for publication on the Teetonic.com website. ORDER PROCESS
- Find What You want to Buy
  Click on shop to view all designs currently available to buy.
  
  To get more info about each design, click on the design and there you will find:
  - a larger image of the design
  - colour and size availability
  - background info
  - the buttons you need to add the tee shirt to your Shopping Bag
- Add it to your shopping bag
  The Shopping bag is where you keep items you wish to buy. Up until the point at which you submit your order (see ‘Proceed to Checkout’ below), You will still be able to delete tee shirts or save them for later if you change your mind. When you find what you want and have selected size and colour click “Add to Shopping Bag”. When you have chosen everything that you want click “View Bag” in the top right hand corner of the home page. To start completing the order form click “Proceed to Checkout”
- Proceed to Checkout
  At this stage you will be asked to complete the order form with your name and address details, delivery requirements and payment details. Only once you have completed the mandatory details and pressed send will the order be completed and submitted to us. Once the order is submitted to us, you will be making an offer to us to buy the products set out in your order, on these terms and conditions only.
- Acknowledgement of Order
  Acknowledgement that your order has been received and passed for processing will be sent to you by e-mail. Please check the order acknowledgement carefully. If the order details are incorrect or you have changed your mind please e-mail orders@teetonic.com immediately. Please note receipt of order acknowledgement does not necessarily constitute or imply our acceptance of your order. Acceptance of your order and the formation of the contract between you and us will occur when we dispatch to you the products ordered, unless you have cancelled your order (see below) or we have notified you that we do not accept your order. Once your order is acknowledged you can normally expect your order to be accepted/dispatched within 3-5 working days. We will notify you if there is any delay or problems with the order (see delivery and dispatch).
  
  We may decline an order for any reason in our sole discretion, although if we do so we will email you to explain why.

- Delivery and Dispatch
  We will e-mail you when your order is dispatched. ( No money will be taken from your payment card until dispatch of your order is imminent)
  
  Orders are sent to UK addresses by Royal Mail and should reach UK addresses within 2-3 working days and we use Air Mail to Overseas addresses (delivery times will vary).
  
  Your order will be sent to you as soon as reasonably possible and will normally be within 3-5 working days from when acknowledgement of receipt of order is e-mailed to you. However should there be any unforeseeable delays you will be kept informed of a revised time of delivery and of course your right to cancel your order if the revised delivery time is unsuitable.

- Payment
  No payment will be taken from your card until just before dispatch of your order. Prices quoted are inclusive of VAT @ 17.5%. Delivery costs (shown below) are payable in addition to the price shown on this website, and are inclusive of postage and packing. Prices are valid for the period shown on this website but may change after you submit your order. If they do, we will notify you by email.
  
  Goods that are dispatched to addresses outside of the European Union are generally not subject to EU VAT. When ordering goods for delivery overseas, you may be subject to import duties and taxes that are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Please refer to Customs Information for more details.
  
  You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer and we may share your personal information with such third parties as are necessary to enable us to do such checks. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

You will become the owner of the products ordered once they have been paid for in full and delivered to you. The risk of loss of or damage to these products becomes yours (once they have been delivered to you).

  We have made every effort to display as accurately as possible the colours of our products that appear on our Site. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

  - We will not be liable to you for any defects in products arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, any failure by you to follow our recommendations for washing and ironing, or any alteration or repair carried out without our approval.

Customs information

When ordering goods for delivery overseas, you may be subject to import duties and taxes that are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

Your privacy is important to us and we know that you care about how information about your order is used and shared. Please see our privacy policy. We would also like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

Also, we may provide certain order, delivery and product information, such as titles, to our international carriers and such information may be communicated by the carriers to customs authorities in order to facilitate customs clearance and comply with local laws.

If the order is a gift, the package is marked "Gift" but the cost of the item is still stated on the customs form. Customs authorities require us to state the value of the gift item directly on the package

OUR RETURNS POLICY
We are sure that you will be very happy with your purchase. However, we will act promptly if the goods we send you are damaged, defective or incorrect. Distance selling regulations also allows customers in the EU a seven day cancellation preiod. Please see below for details of both these services.

Please follow appropriate steps depending on reason for returning goods:-
1. Return of damaged, defective or incorrect goods
  - If the item was damaged in transit
    
    If you take delivery of a package and the contents have been damaged in transit, you can return the item(s) to us within 14 days of receipt for exchange. Please contact us by e-mail (orders@teetonic.com) as soon as possible to inform us of your wish to return your goods, and we will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address. We will arrange for a replacement to be sent and refund the postage cost of returning the item to us.
  - If the item is defective
    
    You have the right to return a faulty item within a reasonable period of time. Please contact us by e-mail (orders@teetonic.com) as soon as possible to inform us of your wish to return your goods, and we will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address. We will arrange for a replacement to be sent and refund the postage cost of returning the item to us.
  - If we sent you an item you did not order (an "incorrect" item)
    
    As soon as you find out we've sent you an incorrect item please contact us by e-mail (orders@teetonic.com) as soon as possible, to inform us of the details of the error, and your wish to return your goods, and we will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address. We will arrange for a replacement to be sent and refund the postage cost of returning the item to us.
    
    Note: in the event that we send you a replacement for a damaged, defective or incorrect item, you must return the original item to us within 30 days of our e-mail confirming the issue of the replacement item. Provided you return this item to us within the 30 days, you will have nothing more to pay. If you do not return the original item to us by the end of the 30 day period, we reserve the right to charge an amount equal to the price of your original order to the payment card you used for the order.
2. Cancellations
  
  By law, customers consumers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered.
  
  We operate a 14 day no quibble money back guarantee
  - If within 7 days you are unhappy with the tee shirt you may return it to us, all tee shirts returned must be unused and in the same condition as it was delivered to you for us to be able to refund any payment.
  - Please contact us by e-mail (orders@teetonic.com) to inform us of your wish to return your goods , and we will allocate you a return code, which you must include in the package to ensure we process your return as efficiently as possible. You must also include your original order number, with your name and address.
  - Wrap the package carefully and send it back to the returns address above. Where possible obtain a proof of posting certificate from the post office, as you are responsible for the package until we receive it returned safely into our warehouse.
  - It is your responsibility to meet the costs of returning the goods to us, and to take care that they are not damaged while in your care or in transit. If you do not return the goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods. If we have not yet refunded you (see below) we may deduct these costs before refunding the balance to you.
  - Any refund will be provided as soon as possible and at the latest within 30 days of us receiving the returned order. We will e-mail you to let you know that the returned item has been received.
  - Unfortunately unless you are a consumer living within the European Union we are not able to reimburse you the initial delivery charge when you exercise your right to cancel the order. You can expect a refund within 30 days in the same form of payment originally used for purchase. If you do not receive a confirmation e-mail of goods returned safely after 4 weeks from the day you sent us your return please contact us for assistance.
DELIVERY PROBLEMS
Where's my order

When you place an order you should receive a reply e-mail acknowledging that your order has been received and your payment card has been debited and a subsequent e-mail when your order is accepted and your goods are dispatched.
- If you haven't received an e-mail acknowledging your order
  Please contact us at info@teetonic.com quoting your order reference number.
- If you have received an acknowledgement that your order has been received then your order is in the system and being processed.
  We promise where possible delivery within 7 days to UK addresses (3-5 days for dispatch and 2-3 days in the postal system) from you receiving confirmation of acceptance of order. In the unlikely event of delivery problems at our end we will keep you informed by e-mail of expected dispatch dates.
  
  If more than 30 days have elapsed and you have not received an e-mail saying that your goods have been dispatched please contact us at orders@teetonic.com.
- If you have received e-mails confirming acknowledging that your order was received and an e-mail confirming that your order has been dispatched but you still have not received it.
  The confirmation of dispatch e-mail will let you know when your order left our fulfilment centre.
  
  Please wait 7 days after the dispatch date before contacting us about a missing order at orders@teetonic.com. During that time we recommend that you ask your local Post Office sorting office if they have already tried to deliver it and ask neighbours if the package has been left with them. You should also check that the delivery address is correct. Please contact us at orders@teetonic.com for help in locating your missing order via the postal system.
